WESTERLY, R.I. (AP) — A man who has been selling shaved ice at Misquamicut beach is defying Westerly's new ban on street vendors, and says he'll take his challenge to court.
George Manko sells shaved ice from his Hawaiian Deserts trailer on Atlantic Avenue, but received a summons last week for violating the street vendor ban, which was approved by the Westerly Town Council in May.
It limits street vendors to working only during special events
Manko tells the Westerly Sun that he needs to make a living, and believes the ban is unconstitutional because it suppresses competition against traditional businesses.
He is due in court on July 24 and if convicted of violating the ban faces up to 30 days in prison and a fine of $500.
