New Beach Access Suit Filed

Rhode Island's new beach access law is drawing a fresh lawsuit.

The Providence Journal reports documents were filed in state court by a family that owns waterfront property in Westerly.

They argue the new law represents an unconstitutional taking of private property, and that the General Assembly should not have overruled a decades-old Rhode Island Supreme Court decision which established the public access point at the average high tide line.

The new law says any beach can be accessed within ten feet of the seaweed line.

A federal judge dismissed a separate lawsuit by the Rhode Island Association of Coastal Taxpayers earlier this month.
